MINERAL ESTATE VS SURFACE ESTATE
Land ownership in Texas is divided into two distinct sets of rights, or “estates”: the surface estate and the mineral estate. In Texas, mineral estate and surface estate are two distinct legal interests in real property. The surface estate is the visible land on the surface, whereas the mineral estate is any minerals contained beneath the surface of that property.
While the mineral estate and surface estate are usually owned by the same person, it is also possible for the two estates to be separated or owned by different entities. Separation between the two estates can occur in a few different ways, including:
- Reservation: When the owner of the land sells the surface estate but retains the mineral estate, this is known as a reservation.
- Exception: When the owner of the land sells the mineral estate but retains the surface estate, this is known as an exception.
- Severance Deed: A severance deed is a legal document that is used to intentionally sever the mineral estate from the surface estate.
