Texas Mineral Rights and Royalties

Oil fields have been in production in Texas since 1901 and the state remains the most productive oil and gas producing state in the United States. Currently, two-thirds of the 254 counties in the state produce mineral royalties for property owners. Mineral rights are included in the state constitution, and under Texas law mineral rights and surface, rights can be severed and sold separately. We will help you understand how we value your assets and how to sell Texas mineral rights to Momentum for a fair, competitive price.

The major basins in Texas include the Permian Basin and the Anadarko Basin. Notable formations include the Wolfcamp/ Bonesprings located in west Texas, the Eagle Ford Shale located in southwest Texas and the Haynesville Shale in East Texas.

MINERAL ESTATE VS SURFACE ESTATE

Land ownership in Texas is divided into two distinct sets of rights, or “estates”: the surface estate and the mineral estate. In Texas, mineral estate and surface estate are two distinct legal interests in real property. The surface estate is the visible land on the surface, whereas the mineral estate is any minerals contained beneath the surface of that property.

While the mineral estate and surface estate are usually owned by the same person, it is also possible for the two estates to be separated or owned by different entities. Separation between the two estates can occur in a few different ways, including:

  • Reservation: When the owner of the land sells the surface estate but retains the mineral estate, this is known as a reservation.
  • Exception: When the owner of the land sells the mineral estate but retains the surface estate, this is known as an exception.
  • Severance Deed: A severance deed is a legal document that is used to intentionally sever the mineral estate from the surface estate.
